How do the New Laws Affect Smoking in Strata?

It’s very clear in the new legislation that smoking has not been taken kindly to with the new bylaws. Owners corporations now have the choice of implementing a standard by-law for their scheme that bans smoking on common property and within people’s lots altogether. If you’re smoking within your unit and your smoke is permeating around the building, it can still be in breach of the by-laws. If you are a smoker, we strongly suggest that you look at the building’s by-laws before deciding to move in or buy, as you may be held liable for breaching the by-laws should you smoke on the property.
